For several months, TikTok has been in the sights of many governments. Albania has proceeded to his ban for one year and the United States opted for a total ban before the intervention of Donald Trump. His lawyers are doing everything to stop the law which will ban the social network from January 19, 2025.

ByteDance is still contesting the constitutionality of this law called “Protecting Americans from Foreign Adversary Controlled Applications Act”. The Supreme Court will hear the arguments of TikTok's parent company on January 10, 2025. In their request, Donald Trump's lawyers describe this deadline as “unfortunate timing” which hinders his “ability to manage United States foreign policy”.

The document does not specify the president-elect's approach to this issue but that it is “the only one with the incomparable negotiating expertise, the electoral mandate and the political will to negotiate a solution to save the platform while addressing the national security concerns expressed by the government.”

The request highlights that Donald Trump has 14.7 million subscribers on the social network, “allowing it to assess the importance of TikTok as a unique medium for freedom of expression, including fundamental political discourse.”

Supporters of the law view TikTok as a threat to national security and fear the Chinese government is using the app to collect data and disseminate propaganda to American users.

During his first term, Donald Trump tried to ban the social network before lending his support. On his social network Truth, the president-elect published, during the presidential elections: “FOR EVERYONE WHO WANTS TO SAVE TIK TOK IN AMERICA, VOTE TRUMP!”

Other organizations have filed their own support for ByteDance such as the American Civil Liberties Union and Electronic Frontier, believing that “the government has failed to present credible evidence of actual or threatened harm caused by TikTok.”
