Twitter France condemned by French justice

The story begins in October 2022 when Elon Musk, whose toll at the head of Doge is not brilliantcan be bought Twitter. The employee, called Ms. G., receives a first message that threatens her post as part of the savings plan while she was on maternity leave. Then come from other emails, sometimes in the middle of the night and signed Elon Musk, qualified as “COMMINATORIES”. Other employees received these messages who asked to redouble their efforts with a 24 -hour response period under penalty of dismissal.

Upon his return from maternity leave, the situation worsened for Ms. G. part of her salary is no longer paid and no medical visit takes place. The former employee is trying to contact human resources, unanswered. Following discomfort, Twitter France refuses to consider it as a work accident.

It was in March 2023 that the employee seized the industrial tribunal with a procedure for taking an act of breaking of contract. The approach asks the justice to recognize that the serious shortcomings of Twitter France constitute a dismissal. At first instance, justice recognizes dismissal without real and serious cause, but not moral harassment.

Twitter France calls on, but here it is: this strategy turns against the company. The Court of Appeal confirms the abusive dismissal and this time recognizes moral harassment suffered by Mrs. G. The court points to the sending of aggressive messages by Elon Musk, in particular with the period of response within 24 hours imposed on French employees.
