Nintendo has just updated the terms of his digital license contract, and the least we can say is that the tone has hardened. In a manifest effort to stem hacking, especially with the‘Imminent arrival of the Switch 2the Japanese firm now allows itself to make any digital product unusable-even the console itself-if it detects a use contrary to its conditions.

It is through a simple update of the conditions of use that Nintendo has made one of its firmer messages for years. Clearly: any unauthorized use of a digital product – whether it is a modified game, an emulator, or an attempt to bypass the protections – could lead to the pure and simple blocking of the game concerned, even the whole machine. The United Kingdom is particularly concerned with a detour formulation: “Unauthorized use can make the product unusable”.
In the United States, the mention is even more explicit: the company gives itself the right to deactivate remotely the services linked to the Nintendo account and/or the Nintendo equipment concerned, in whole or in part. This new legal framework considerably expands the company’s field of action in the fight against illegal practices.
You acknowledge that if you do not respect these restrictions, Nintendo can make the Nintendo account services and/or the Nintendo device concerned definitively unusable, in whole or in part.
In parallel, Nintendo has also revised its privacy policy: now, the console will be able to record – with your agreement – the last three minutes of vocal chat or video during an online session. The objective displayed: guarantee an environment “Sure and family”. This measure anticipates the launch of Game Chat, a new social functionality of the Switch 2, which will allow integrated video calls during the game.
This hardening occurs while Nintendo multiplies judicial actions: closure of the famous Yuzu emulator, trial against a streamer broadcasting hacked versions, and legal victory against Dstorage in France.
